These Terms of Service ("Terms") govern your access to and use of so2digital.com and any related content, tools, and services offered by Supplemental Oxygen Digital, LLC ("sO2digital," "we," "us," or "our"). By using the site, you agree to these Terms. If you do not agree, do not use the site.

This website provides information about our media services and the Atlas platform. Paid services are governed by a separate written agreement, insertion order (IO), or statement of work. Where those documents conflict with these Terms, the signed agreement controls for that engagement.

Pricing referenced on this site (including CPM rate cards and minimums) is indicative and subject to a written IO. Promotional or founding-cohort terms apply only as expressly stated in your agreement.

You agree not to:

• Use the site for any unlawful, infringing, or harmful purpose;
• Attempt to gain unauthorized access to our systems or data;
• Interfere with or disrupt the site or its infrastructure;
• Scrape, copy, or reuse content except as permitted by these Terms or applicable law.

The site, the Atlas platform, and all related content, trademarks, and software are owned by or licensed to sO2digital and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the site for its intended purpose. No other rights are granted.

If you provide audience files, creative, or other materials, you represent that you have the rights and permissions necessary to do so and to authorize our use of them to deliver services. You retain ownership of your materials; we process them under our agreement and our Privacy Policy.

The site may reference or link to third-party platforms and services that we do not control. We are not responsible for the content, policies, or practices of third parties.

The site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure. Performance figures and case results described on the site are examples and are not a guarantee of future results.

To the maximum extent permitted by law, sO2digital and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the site. Our total liability for claims relating to the site is limited to one hundred U.S. dollars ($100). Liability under a signed services agreement is governed by that agreement.

You agree to indemnify and hold harmless sO2digital from claims, damages, and expenses arising out of your misuse of the site or violation of these Terms or applicable law.

These Terms are governed by the laws of the State in which Supplemental Oxygen Digital, LLC is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in that jurisdiction, unless your signed agreement specifies otherwise.

We may update these Terms from time to time. Continued use of the site after changes take effect constitutes acceptance of the revised Terms. We will revise the "Last updated" date above when we make changes.
